Terms of Service

Welcome to Coutto Pattern (“we”, “our”, or “the App”). Please read these Terms of Service carefully before using our mobile application (iOS and Android), website at coutto.app, and related services. By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use our services.


1. Acceptance of Terms

1.1 Scope of Agreement

These Terms of Service (“Terms”) constitute a legally binding agreement between you and Coutto Pattern regarding your use of our mobile application and related services. These Terms apply to all users, including visitors, registered users, and others who access our services.

1.2 Age Requirements

You must be at least 13 years old (or the applicable age in your jurisdiction) to use the App. If you are under the legal age, you must use this service with the consent and supervision of a parent or legal guardian.

By using the App, you represent that:

  • You meet the legal age requirement, or have obtained guardian consent
  • You have read, understood, and agree to be bound by these Terms and our Privacy Policy
  • You will comply with all applicable laws and regulations


2. Service Description

2.1 Service Content

Coutto Pattern is a mobile application for fashion designers and sewing enthusiasts, providing:

  • Viewing and managing pattern files (PDF, SVG, DXF, PLT, and more)
  • Projector-assisted pattern cutting and size calibration
  • Stitching A4/A3 PDF patterns into full-size layouts
  • Pattern printing, including tiled printing for home paper sizes
  • User account management and cloud data synchronization
  • Personalized settings and preference storage
  • Sewing community sharing and interaction (where available)

2.2 Service Availability

We strive to keep the service available, but do not guarantee that:

  • The service will always be available, uninterrupted, or error-free
  • The service will meet all your requirements
  • All errors will be corrected

We reserve the right to modify, suspend, or discontinue any part of the service at any time, and will provide notice of material changes where practicable.

2.3 Third-Party Services

The App may rely on third-party services such as Apple App Store, Google Play, cloud storage, and analytics providers. Those services are governed by their own terms and privacy policies. We are not responsible for third-party conduct.


3. User Accounts

3.1 Account Registration

Certain features may require an account. When registering, you agree to:

  • Provide accurate, complete, and up-to-date information
  • Maintain and promptly update your account information
  • Keep your credentials confidential
  • Accept responsibility for all activity under your account
  • Notify us immediately of any unauthorized use

3.2 Account Security

You may not share credentials or use another person’s account. You are responsible for losses arising from failure to safeguard your credentials.

3.3 Account Deletion

You may delete your account at any time via in-app settings or by contacting us. After deletion, we will delete or anonymize your personal data as described in our Privacy Policy, except where retention is required by law.


4. In-App Purchases and Subscriptions

4.1 Paid Features

Some features are available through in-app purchases or subscriptions. Pricing, billing periods, and entitlements are displayed in the App and on the applicable app store.

4.2 Payment and Refunds

  • All transactions are processed through Apple App Store or Google Play; we do not directly collect or store payment card information
  • Refunds are subject to the policies of the app store you used
  • Subscriptions renew automatically at the selected interval until cancelled in your app store account settings

4.3 Price Changes

We may change prices. Changes will be posted in the App or app store listing and apply to subsequent billing periods.


5. User Conduct

5.1 Permitted Use

You agree to use the service only for lawful purposes and in compliance with these Terms and applicable law.

5.2 Prohibited Activities

You agree not to:

  • Use the service for any unlawful purpose
  • Upload or share content that infringes intellectual property, privacy, or other rights
  • Upload malware, viruses, or harmful code
  • Attempt unauthorized access to the service, other accounts, or related systems
  • Interfere with or disrupt the service (including scraping, reverse engineering, or circumvention)
  • Impersonate any person or misrepresent your affiliation
  • Use the service to send spam or harass others


6. Intellectual Property

6.1 Our Intellectual Property

The App and all related content (including software, designs, trademarks, logos, documentation, and tutorials) are protected by copyright, trademark, and other intellectual property laws and are owned by us or our licensors. You may not copy, modify, distribute, or create derivative works without our written permission.

6.2 Your Content

You retain ownership of content you upload, create, or submit (“User Content”). By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to store, process, display, and transmit it solely to provide and improve the service.

You represent that you have the necessary rights to your User Content and that it does not infringe third-party rights.

6.3 Infringement Notices

If you believe content on the service infringes your intellectual property, contact us using the details in Section 15 with proof of ownership and details of the alleged infringement.


7. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the service, you consent to our data practices as described there.


8. Disclaimer

8.1 Service “As Is”

The service is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

8.2 Cutting and Measurement Risk

Projector cutting, calibration, and related features depend on device accuracy, projector setup, and user operation. We do not guarantee cutting precision. You must verify measurements before cutting fabric. We are not liable for material loss from reliance on the App for cutting.

8.3 Use at Your Own Risk

You understand and agree that:

  • You use the service at your own risk
  • We are not liable for interruptions due to force majeure, third-party failures, or network issues
  • We are not liable for indirect, incidental, special, or consequential damages


9. Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability arising from these Terms or the service shall not exceed the greater of: (a) amounts you paid for the service in the past 12 months; or (b) USD $100 (or equivalent)
  • These limits do not apply to damages caused by our willful misconduct or gross negligence, or where exclusion is prohibited by law


10. Indemnification

You agree to defend, indemnify, and hold harmless us and our affiliates from claims, losses, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, misuse of the service, or infringement of third-party rights.


11. Termination

11.1 Your Right to Terminate

You may stop using the service at any time by:

  • Uninstalling the App
  • Deleting your account
  • Ceasing use of the service

11.2 Our Right to Terminate

We may suspend or terminate your access immediately if:

  • You violate these Terms
  • You engage in fraud, abuse, or unlawful activity
  • Required by law or government order
  • We discontinue the service

Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.


12. Changes to Terms

We may revise these Terms from time to time. For material changes, we will notify you via in-app notice, website announcement, or other reasonable means. Continued use after changes take effect constitutes acceptance. If you disagree, stop using the service and delete your account.


13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the People’s Republic of China (excluding conflict-of-law rules), except where mandatory consumer protection laws in your jurisdiction require otherwise.

13.2 Dispute Resolution

Disputes arising from these Terms shall first be resolved through good-faith negotiation. If negotiation fails, either party may bring suit in a court of competent jurisdiction at our principal place of business.


14. General Provisions

  • Entire agreement: These Terms and the Privacy Policy constitute the entire agreement between you and us
  • Severability: If any provision is held invalid, the remaining provisions remain in effect
  • No waiver: Failure to enforce any right does not waive that right
  • Assignment: You may not assign your rights or obligations without our written consent; we may assign these Terms in connection with a merger, acquisition, or asset transfer
